Is there a provisional patent application procedure?
The provisional patent application procedure at the INPI, available from July 1, 2020, offers the possibility of filing a patent application in provisional form.
This simplified and inexpensive procedure compared to a traditional patent application does not create a new industrial property title but allows companies wishing to protect their innovations to initiate the filing of a patent application.
By filing a simple technical description of the invention, the provisional patent application grants anticipation date and give birth to a right of priority. From the date of filing, the depositor thus has a period of 12 months if he wishes to proceed with compliance with a view to obtaining a patent or transformation into a utility certificate.
